There should be an entity to oversee the work and conduct of prosecutors, Gov. Andrew Cuomo said Wednesday in a radio interview a day after a state judge ruled a prosecutorial conduct commission was unconstitutional. 

"I think DAs should have a check and a balance," Cuomo said in an interview with WAMC public radio. "DAs are capable, there's humanity there. There's flaws and foibles."

He added, "There's a possibility that there's misconduct by a DA and there should be an apparatus to contemplate that and address that." 

The ruling determined the law creating the commission violated the state's constitution. Cuomo had previously acknowledged problems with the law as written, and signaled plans to work with lawmakers to make changes. 

But the changes and implementation of the panel were put on hold as the District Attorneys Association of New York challenged the measure.
