The East Side Parkways Coalition has filed an appeal against the New York State Department of Transportation.

The suit alleges violations of the Public Trust Doctrine and New York State Green Amendment when the original Humboldt Parkway was turned into the Kensington Expressway back in the 1950s and '60s.

"The Kensington Expressway specifically has damaged the residents of our fair city," Sherry Sherrill, founder of East Side Parkways Coalition, said.

The group refuses to accept the DOT's current plan and wants Humboldt Parkway fully restored back to park land. They add that the highway and pollution has created health concerns. 

DOT officials say they do not comment on pending litigation.

The project is currently on pause after a state Supreme Court ruled that the DOT didn't do a thorough environmental review and until the state performs a more detailed study, the project cannot begin.
